You know the jingle: "Five dollar. Five dollar. Five dollar Footlong." For some that's just a slogan from Subway, but for Chicago's Nguyen Buren, it is a binding contract and Subway broke it. Buren measured a footlong and found it was under 11 inches. He sued for $5 million, accusing Subway of a "pattern of fraudulent, deceptive and otherwise fraudulent advertising, sales and marketing practices." Subway noted that baking practices at individual franchises might not live up to corporate standards; however, they pledged to make sure ever sandwich is the correct length.
